Since insurance companies are only interested in how inexpensively they can settle an injured party’s claim without regard to the pain and suffering the victim has experienced, it is imperative that the insurance company immediately understand that the victim’s attorney has the ability and experience to litigate a claim through trial. Since trials are extremely expensive for the insurance companies (hiring lawyers, expert witnesses, etc.), without the fear of bearing high legal/related litigation costs and risking losing a large judgment, there is no motivation by the insurance companies to settle a claim except on their terms and only in their best interest.
